An interim injunction had been sought by LBC as a matter of urgency to restrain a threatened breach of confidence by the Defendants. It was granted by Mrs Justice O’Farrell on 30 August 2017 and continued until trial or further order on 6 September 2017 by Mr Justice Lavender who gave short reasons for his judgment: [2017] EWHC 2257 (QB). On 6 June 2018, the Second and Third Defendants agreed to be bound by a final injunction. The trial of LBC’s Part 8 claim for a final injunction against the First Defendant was due to commence on 5 November 2018 but settled shortly before upon the First Defendant agreeing to be bound by a final injunction. On 5 November 2018, Mr Justice Knowles granted the final injunction and made an Order for the costs of the proceedings in LBC’s favour. He also ordered that there should be a further hearing on the apportionment of such costs as between the Defendants.
